WHO IS RESPONSIBILE FOR THE DATA?

All information, data, text, or other materials (“Data”) submitted to or published on the Service is the responsibility of the person or entity that submits the Data. Data is compiled and calculations are made based on information supplied by or on behalf of the applicable financial institutions.

The User acknowledges that search results obtained using this Service depends on the accuracy of the Data submitted. The User agrees that he or she will bear all responsibility for the use of any Data and calculation results, including reliance on the accuracy, completeness, timeliness or usefulness of such Data.

CANNEX does not control or screen the Data submitted using this Service. CANNEX shall have the right (but not the obligation) to refuse or delete any Data that is submitted using the Service, including without limitation any Data that violates the User Policy or is otherwise objectionable.

WHAT ARE THE TYPES OF DATA CHANGES THAT CAN BE MADE?

The Data published on this site are updated regularly. CANNEX and its suppliers and licensees may make improvements or changes in the Service or the contents of any site at any time. Users are responsible for re-visiting the site to obtain the current information.

MAY I PRINT CALCULATION AND SEARCH RESULTS?

Calculation and search result pages may contain material that is copyrighted by others and all copyright owners have reserved all rights, except as expressly provided. Users may save and print copies of the search results for their own use. The search result pages may not otherwise be copied or retransmitted without the express written consent of CANNEX.

Elements of the Service are protected by copyright, trademark, trade dress and other laws. No logo, graphic, sound or image may be copied or retransmitted unless expressly permitted by CANNEX. CANNEX’s trademarks include: CANNEX, CANNEX PAY INDEX, ILY, IMPLIED LONGEVITY YIELD, TILY, TAXABLE IMPLIED LONGEVITY YIELD, RIPE, PrARI, PENSIONIZE, PENSIONIZATION, QWeMA NumeRICs, QWeMA and SIMPLY RELIABLE DATA.

The User acknowledges and agrees that CANNEX is not responsible for the availability of any linked site or any products or services available from a linked site. CANNEX does not endorse and is not responsible for any content, advertising, products, services or other material on or available from such sites or resources. CANNEX shall not be responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused by use of, or reliance on, any such content, goods or services.

The User’s correspondence or business dealings with, or participation in promotions of, financial institutions or other third parties found on or through the Service, including payment and delivery of related goods or services, and other terms, conditions, warranties or representations associated with such dealings, are solely between the User and such financial institution(s) or other third parties. The User agrees that CANNEX shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such financial institution on the Service.

WHAT ARE THE PROHIBITED DATA AND ACTIVITIES?

Customer shall not, and shall not permit any User to, and User shall not use the Service to submit:

  • any material that Users do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); or
  • any material that infringes any patent, trademark, trade secret, copyright, publicity or other proprietary right (“Rights”) of any party; or
  • any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

Customer shall not, and shall not permit any User to and User shall not use the Service:

  • to create false, misleading or duplicative addresses in order to disguise the destination of any Data transmitted through the Service; or
  • to interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; or
  • in violation of any applicable local, state, provincial, national or international law and any regulations having the force of law, including, but not limited to, any applicable securities laws or regulations and any laws for the protection of personal information.

UNDER WHAT CIRCUMSTANCES WILL CANNEX TERMINATE OR SUSPEND ACCESS TO THE SERVICE?

CANNEX may remove Data, suspend any User’s access, or terminate the User’s account, without prior notice if CANNEX believes, in its sole discretion that the User is in breach of this User Policy. CANNEX reserves the right to reject or refuse any order, application or submission from any person or entity in any country, state or jurisdiction where CANNEX or its suppliers, customers or users are not licensed or qualified to carry on business.

UNDER WHAT CIRCUMSTANCES WILL CANNEX DISCLOSE DATA OR INFORMATION ABOUT A USER?

CANNEX may preserve, remove or disclose Data, including information about the account of any Customer or Users, or their use of the Service, to any third party if required to do so by government, court order or other legal process.

We may also use or disclose Data with a User’s knowledge or consent to protect our rights or interests or to resolve any disputes between Users and a financial institution(s) arising from the use of the Services.

WHAT IS THE LIABILITY OF CANNEX REGARDING DATA?

CANNEX Financial Exchanges Limited makes commercially reasonable efforts to ensure that the information is reliable and accurate, but does not warrant the integrity, quality, timeliness, accuracy or security of any Data or quotation.

BY USING THIS SERVICE, YOU AGREE THAT IN NO EVENT SHALL CANNEX FINANCIAL EXCHANGES LIMITED BE LIABLE FOR ANY DAMAGES ARISING FROM ANY ERROR OR OMISSION IN ANY DATA OR QUOTATION YOU SUBMIT OR OBTAIN USING THIS SITE, REGARDLESS OF CAUSE.

HOW DOES CANNEX PROTECT MY PRIVACY AND KEEP MY DATA SECURE?

CANNEX will employ privacy and security measures in accordance with CANNEX’s Privacy and Security Policy as amended from time to time, a current copy of which is available on CANNEX’s website at www.cannex.com or a successor website address Privacy and Security Policy.
